Terms of Service

1. About these terms

These Terms of Service (the “Terms”) are a legally binding agreement between you and Vardoxen (“Vardoxen”, “we”, “us”, or “our”) governing your use of the website at vardoxen.tv and the services made available through it (together, the “Service”). By accessing or using the Service, creating an account, or making a submission, you confirm that you accept these Terms and our Privacy Policy and Cookie Policy, and that you agree to comply with them. If you do not agree, you must not use the Service.

2. Who we are and how to contact us

The Service is operated from the United Kingdom by the operator of Vardoxen. You can contact us at legal@vardoxen.tv or through our contact page. We may contact you using the email address associated with your Discord account or through the Vardoxen Discord server. References to writing or written communication in these Terms include email.

3. The services we provide

The Service offers, in whole or in part and subject to change, the following:

• A public marketing site, including sponsors, links, and support pages.
• Discord sign-in and a member account.
• An anonymous submissions board that may be read out during a stream segment.
• Giveaways you can view and enter.
• Patreon account linking, supporter perks, and a public Wall of Support.
• Tracked outbound links, a contact route, and an appeals route.

Some features depend on third parties (such as Discord, Patreon, PayPal, and TikTok) and may be unavailable, delayed, or changed from time to time. We may make the Service, or particular features, available only to certain users (for example, signed-in members or supporters).

4. Eligibility

You must be at least 13 years old, and old enough to use Discord in your country, to use the Service. By using the Service you confirm that you meet this requirement and that you are able to enter into a binding agreement. If you are under the age of 18, you confirm that you have permission from a parent or guardian to use the Service. We may refuse, suspend, or close accounts where we reasonably believe this requirement is not met.

5. Your account

Authentication is provided through Discord OAuth2; we do not store a password for you. You are responsible for keeping access to your Discord account secure and for all activity that takes place through your Vardoxen account. You must tell us promptly if you believe your account has been accessed without your permission. We may suspend, restrict, or terminate your account, with or without notice, if you breach these Terms, our Community Guidelines, or applicable law, or to protect the Service or the community.

6. Acceptable use

You must follow our Community Guidelines at all times. You must not use the Service to do anything unlawful, including sharing content that is illegal under the law of England & Wales or that is a priority offence or otherwise harmful content under the Online Safety Act 2023. You must not:

• Harass, threaten, defame, impersonate, or abuse any person.
• Share another person's private information, or intimate images, without consent.
• Upload malware, attempt to gain unauthorised access, or disrupt, overload, or attack the Service.
• Scrape, harvest, or systematically collect data, or use bots or automated means, except as we expressly permit.
• Reverse engineer, copy, or create derivative works from the Service except to the extent the law allows.
• Use alternate accounts or other means to evade moderation, bans, or giveaway rules.

7. User-generated content and licence

You retain ownership of any content you submit, including submissions, appeals, reports, and messages (“Your Content”). By submitting Your Content you confirm that you own it or have the right to share it, that it does not infringe anyone else's rights, and that it complies with these Terms. You grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, adapt for display, publish, moderate, and, where relevant, read out or feature Your Content on stream and on the Service, for the purpose of operating, promoting, and improving the Service. This licence continues for as long as we display or retain Your Content and for a reasonable period afterwards for backup, audit, and legal purposes. We may remove, refuse, archive, or block any content or user at our discretion, including content that breaches these Terms or that we are required to remove.

8. Our content and intellectual property

The Service, including its design, text, graphics, logos, and software (but excluding Your Content and third-party content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. The names “Vardoxen” and related logos are our marks and may not be used without our permission. Third-party names and marks belong to their respective owners.

9. No professional advice, and no liability for reliance

The submissions board and any stream segment are entertainment. Content you share, and any responses, opinions, comments, or advice given by Vardoxen, moderators, guests, or the community, are personal views and general information only. They may include advice, but they are not professional advice: we are not doctors, lawyers, accountants, financial advisers, therapists, or other professionals, and no professional relationship (such as doctor-patient or lawyer-client) is created. You rely on anything said, read, or featured entirely at your own risk and you are solely responsible for any decision or action you take. To the fullest extent permitted by law, Vardoxen accepts no liability for any loss, harm, or damage arising from reliance on anything shared, read, said, or featured through the Service. For any serious matter, seek a suitably qualified professional or an appropriate support line or emergency service.

10. Submissions and the stream segment

Submissions are reviewed before they appear, and only approved submissions are shown publicly, and only after they have been read on stream. Please keep submissions lawful and within the guidelines, and do not post graphic, traumatic, self-harm, abuse, or crisis content. How submissions are stored and moderated is explained in our Submissions Policy. Although submissions are displayed without your name, they are not anonymous to us; please read the Submissions Policy before submitting.

11. Giveaways

Giveaways are run for the community and are void where prohibited by law. Eligibility and entry requirements are shown with each giveaway. Entries may be removed for rule-breaking or for using alternate accounts, winners are selected at random, and our decisions are final. Giveaways are not sponsored, endorsed, administered by, or associated with Discord, Patreon, PayPal, TikTok, or any other platform. No purchase is necessary to enter unless expressly stated, and entry is not conditional on any payment to us.

12. Donations, supporters, and the Wall of Support

Donations and pledges are processed by third parties (Patreon, PayPal, and TikTok) under their own terms, and we do not receive or store your full payment details. Donations are voluntary and, except where required by law or the relevant platform's rules, are non-refundable. Supporter recognition, including supporter roles and the public Wall of Support, is a discretionary thank-you and not a guaranteed or purchased benefit; we may change, withhold, or remove it. Linking your Patreon is optional; see the Privacy Policy. Any future merchandise or paid subscriptions sold directly by us will be governed by a separate sales, refund, and cancellation policy consistent with UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

13. Reporting, complaints, and appeals

You can report content or users, and we handle reports in line with our duties under the Online Safety Act 2023. If you disagree with a moderation decision, you may submit one appeal and one re-review per decision through our appeals route, after which the decision is final. To raise any other concern or complaint, contact us through the contact page or at legal@vardoxen.tv, and we will respond within a reasonable time.

14. Third-party services

The Service links to and relies on third parties (including Discord, Patreon, PayPal, TikTok, YouTube, and Twitch). We are not responsible for third-party services, content, or websites, which are governed by their own terms and privacy policies. Your dealings with third parties are solely between you and them.

15. Availability and changes to the Service

The Service is provided on an “as available” basis. We may add, change, suspend, withdraw, or discontinue the Service or any feature at any time, and we do not guarantee that the Service will always be available or uninterrupted. We will give reasonable notice of significant changes where we can.

16. Changes to these terms

We may update these Terms from time to time, for example to reflect changes in the Service or in the law. The “Last updated” date above shows when the latest version took effect. For significant changes we will take reasonable steps to let you know, such as a notice on the Service. Your continued use of the Service after changes take effect means you accept the updated Terms.

17. Suspension and termination

You may stop using the Service at any time and ask us to close your account. We may suspend or end your access to all or part of the Service if you breach these Terms or where we reasonably need to in order to protect the Service or others. On termination, the licences you grant in section 7 survive to the extent needed for backup, moderation, and legal purposes, and any terms which by their nature should continue (including sections 7 to 9, 18, and 19) will remain in force.

18. Disclaimers and liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under the law of England & Wales. Subject to that and to section 9, the Service is provided without warranties of any kind, whether express or implied, including as to accuracy, availability, or fitness for a particular purpose. We are not liable for any loss or damage that is not reasonably foreseeable, for any business loss (the Service is for personal, non-commercial use), or for loss caused by events outside our reasonable control. If you are a consumer, your statutory rights are not affected by these Terms.

19. General

If any provision of these Terms is found to be unenforceable, the rest will continue in force. Our failure to enforce a right is not a waiver of it. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours where your rights are not affected. These Terms are the entire agreement between you and us about the Service. A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce them.

20. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the law of England & Wales. The courts of England & Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
